SCIENCE IS THE DRIVING FORCE OF PROGRESS

Science in general and legal science in particular is a sphere of human activity whose main function is the development and theoretical systematization of objective knowledge about the surrounding reality. Science is a form of social consciousness.

Science has been, is, and will continue to be a driving force for the progressive development of society and humanity as a whole.

Legal science of sovereign Kazakhstan, at the present stage of development, as an integral part of public consciousness, studies the legal reality. Today, legal science is designed not only to study and systematize legal realities, but also to develop concrete proposals for those public relations that need to be regulated by law.

The main task of legal science is to clear the way for law and legislation. The achievements and results of legal science should be used by the legislator in the process of law-making activities in the preparation of legal acts, their improvement.

Legal science must respond in a timely, objective and adequate manner to all changes occurring in society and the state in order to promptly make proposals to the legislator on those public relations that need to be regulated by the relevant norms of law and legislation.

Unfortunately, we have to state that the legal science of Kazakhstan is currently going through "not the best days", but I am optimistic about the future and am confident that the domestic legal science will be reborn and flourish. Legal science plays a leading role in building legal statehood in our country, is the theoretical basis of the legislative process, and therefore the progressive development of society and the state. It serves as the basis for legislation aimed at protecting human rights and freedoms.

Today, the D. A. Kunaev Eurasian law Academy has a sufficient research base and is represented by leading scientists of Kazakhstan, such as Professor Zhalairi O. sh., Professor Aitkhozhin K. K., Professor Uvarov V. N., Professor alibayeva G. A. and others.

SCIENCE DAY

April 12 in the Republic of Kazakhstan is known as the "Day of Scientific Workers". Scientists, researchers and employees of scientific and education organizations celebrate their professional holiday on this day. "Day of Scientific Workers" solves an important task – a national commitment to the use of science for the benefit of society.

On October 20, 2011, the Decree of the President of the Republic of Kazakhstan No. 164 established the "Day of Scientific Workers", which is since annually celebrated on April 12. The celebration was first held in 2012.

The holiday’s date was dedicated to the birthday of the first President of the Academy of Sciences of the Kazakh SSR Kanysh Imantaevich Satpayev. The great scientist-geologist K.I. Satpayev was not just elected the first President of the Academy of Sciences, but was in fact its creator, having put a lot of effort to it. Today, the National Academy of Sciences of the Republic continues to be the main hub of science and research of Kazakhstan.

Of course, Eurasian Law Academy anmed after D.A. Kunaev did not stay away from this celebration: today, on April 12, our alma mater hosts the "Science Week", which pursues two important goals: first, to sum up the research activities of the Academy, and secondly, to attract prospective scientists - students, undergraduates and doctoral students. Variety of round tables, lectures, meetings with famous scientists are being held for them. The Academy has seen an increase in the number of scientific publications in international publications, an increase in the number of international scientific contacts all of which indicates the development of research cooperation, increased access to international information resources, etc. In addition, the "Science Week" at the Eurasian Law Academy is also an occasion to draw the public's attention to current issues, draw attention to the challenges currently faced by science, and increase society’s support for scientific activities.

Science and innovation are key components of the success of a modern university. Science is the engine of technological progress, the key to social development. Scientists of the Eurasian Law Academy have also made a great contribution to the development of legal science for more than two decades. Their research activities contribute the achievements of both foreign and Kazakh science, as well as open new horizons for research.

The Eurasian law Academy has a number of developed scientific schools which educate a new generation of researchers.

In connection with the celebration of Science Day in Kazakhstan, we would like to congratulate our colleagues on the holiday and wish you health and creative success during this difficult time!

 

The Department of Constitutional, International Law and Customs affairs of our Academy is worthy of recognition as a department of active scientific activity. It has a strong professional composition. Only one list of the names of professors, doctors of law speaks volumes. The rector of the Academy, O. Zhalairi, as a member of the Legal Policy Council under the President of the Republic of Kazakhstan, takes an active part in the development of topical issues of modern law and legislation. Professor K. Aitkhozhin one of the most productive experts in the field of constitutional law of the country. Professor E. Duysenov successfully works in the field of research on problems of public administration, the relevance of which is discussed not only in scientific forums, but also shares its views on the pages of popular media, as well as conducts scientific examination of the current constitutional law "On the Parliament of the Republic of Kazakhstan" and the current law "On the Government of the Republic of Kazakhstan".

 

Professor G.A. Alibayeva, Vice-Rector for Research and International Relations, organizer of all scientific and international activities of teachers and students of the university. Associate Professor B.K. Ilyasova, Vice-Rector for Educational and Methodological Work, organizer of the educational process at the Academy. Professor E.Z. Bekbaev and Professor E.N. Rakimbaev came from the public service, having extensive experience working in the highest authorities. Professor O. Samatov, specializing in international law and international relations, actively cooperates with international organizations, directly combines theory with practice. Professor G.T. Baisalova, a former customs officer, is now a successful specialist in the field of customs. Associate Professor O.K. Maybasarov - pre-historical sciences, especially the history of Kazakhstan. Associate Professor K.S. Birzhanova, in addition to being interested in the theory of state and law, is actively engaged in the development of students, leading the Scientific and Student Club on the problems of the modern state and law. Senior Lecturer K. Khavdal is an experienced teacher and mentor in the Kazakh branch. Young and very promising teachers of the department: Ph.D. Associate Professor D. Abdіlda - an example of discipline and order; Lecturer Zh. Tarap is deputy head of the department, manages to combine scientific with a large organizational work. Masters of Law are E. Altynbaev, D. Muzapar, A. Assanova, Sveta Li, they recently joined our team and became its active part. The experience and authority of venerable scientists, the enthusiasm and energy of young people create at the large department an unusually creative atmosphere of direct discussions of pressing problems of education and science, during which interesting and promising ideas arise, from the point of view of scientific research, of practical significance.

 

 

 

These discussions become a storehouse of knowledge for young teachers who enthusiastically pick them up and include them in the educational process and scientific publications.

 

The main direction of scientific activity of the department is the study of the modern constitutional process in the Republic of Kazakhstan, a wide aspect of which is due to a number of problems of the socio-economic, political, legal, moral state of the country. Accordingly, the main areas of research were those objective and subjective circumstances that form the basis of the constitutional and legal development of the country. The most relevant of them became the subject of a collective study of the planned theme "Scientific and theoretical foundations of the essence and content of the Constitution of the Republic of Kazakhstan." This monographic study reflected such pressing issues of today as the need for structural changes in government, the difficult relations of local government with the population related to the implementation of adopted state programs that affect the basic interests of members of society.

 

The broad coverage of constitutionalism, as a doctrine of the Constitution and as a guide to the action of society, the state, and the individual, has found expression in numerous publications. The main ideas and suggestions were tested at various levels of scientific and practical events conducted by public authorities and scientific communities. The timeliness and scientific validity of these ideas, the high professionalism of the members of the department became the basis for cooperation with the Parliament, the Constitutional Council, the Institute of Legislation and Legal Information of the Ministry of Justice and relevant local government agencies. Particularly close relations of the department have developed with the Constitutional Council of the country, which are carried out in joint scientific and practical conferences, round tables, scientific seminars, in expert opinions on the conformity of the current norms of law with the Constitution, in scientific article-by-article comments of the Constitution of the Republic of Kazakhstan. Thus, when writing a Scientific and practical commentary on the Constitution of the Republic of Kazakhstan in Kazakh and Russian languages in 2015 and 2018, scientists professors O. Zhalairi, K. Aitkhozhin, G. Alibayeva, E. Duysenov participated.

 

Persistent attention was directed to the defining significance of the ideological function of the Constitution, which until now has been shyly either suppressed or mentioned in passing. (K. Birzhanova. Ideological function of the Constitution of the Republic of Kazakhstan.)

 

Particular interest was shown in the study of topics aimed at justifying the priority of the second section of the Constitution "Man and citizen". The authors in their research focus not only on their theoretical justification, but also give real ideas about the most vulnerable social areas, such as the legal status of children and women. As a result of these studies, proposals were made to strengthen guarantees of their constitutional rights and effective measures to protect their legitimate interests. (G. Alibayeva. In addition, the Russian literature, which has practical significance, as it turned out, there is not enough comparative state and legal research of regional significance. To our credit, this gap is filled by the research of professors K. Aitkhozhin, E. Duysenov, E. Rakimbaev.

 

All research is conducted on the basis of analysis of the state of constitutional norms for compliance with the real needs of social development, their direct effect and direct application.

 

Numerous scientific articles confirm the comprehensive approach to this topic, and the knowledge and conclusions obtained are reflected in the educational process.

Modern science in the Republic of Kazakhstan continues to develop. This is given special attention by the state authorities, who openly recognize the fact that without the development of science, the future of the country and people is very uncertain, while concern for its development is the key to successful development and growth of the welfare of the state and citizens. One of the priorities of state development, the President of the country attributed Kazakhstan's entry into the top 30 developed countries of the world by 2050. The high role of science in the country's achievement of this goal was particularly noted by him.

 

Today, science has become the main factor in the development of all spheres of human activity. The ability of a nation to maintain a modern and efficient system of science inevitably increases the number of scientific achievements. Also, science is an important industry that develops the country's competitiveness. To date, the teaching staff of the Department of "Economic and General education disciplines" contributes to the development of science.

 

The research topics of the Department members are quite broad: the development of ideas about the theory of financial relations, the study and monitoring of state and municipal finances, research of financial asset quotes, investment and financial activity in the markets, analysis of corporate Finance, corporate governance and financial law, the study of the banking sector and monetary circulation in the country, the study of fundamentally new forms of financial relations-the so – called "Islamic" Finance.

 

ü Members of the Department are actively published in leading professional journals of Kazakhstan and foreign countries.

 

ü Organization of conferences, a variety of round tables is organized in the Department on a regular basis.

 

From 2019 the staff of the Department conducts scientific research on the topic «Қаржы нарықтарында инвестициялық үдерістерді мемлекеттік басқару» governance of the investment process in the financial market"), registered in national center for performing arts. According to the results of research work in 2020, the faculty of the Department published 10 publications in the materials of international and national conferences, 10 publications in journals, including those recommended by the Committee for control in the field of education and science of the Ministry of education and science of the Republic of Kazakhstan, RSCI. In 2020, the faculty of the Department published 2 scientific articles in rating journals with impact factor included in the SCOPUS database. Teaching staff of the Department took part in professional development during the reporting period, 30 certificates were received.

 

The teaching staff of the Department organizes and actively participates in scientific conferences, seminars of regional, national and international levels. The main results of scientific research are published annually in collections, scientometric publications, journals recommended by the KKSON MES RK. An important role in the scientific and research activities of the Department is played by the research work of students studying under the educational programs of the Department.

 

Teachers and students of the Department have the opportunity to share their experience with visiting professors of partner universities and receive advice.

 

The Department together with the students created the scientific circle "Qarzhiger". The purpose of this scientific circle is to discuss topical issues of Economics, Finance, management, development of youth entrepreneurship, improving entrepreneurial skills, accounting and reporting in organizations. Participants of the scientific circle develop scientific projects recommended for participation in competitions at the level of the Academy and the Republic.

 

Department of criminal law and law enforcement acitivity

Today we can say that science in modern society plays an important role in many sectors and spheres of people's lives. The level of development of science is one of the main indicators of the development of society, and it is also an indicator of the modern development of the state. Everything around a person is an achievement of science.

In this regard, the teaching staff of the Department of Criminal law and law enforcement congratulates all employees of the education system on the professional holiday of Kazakhstan-the day of science workers, established by the decree of the President of the Republic No. 164 of October 20, 2011.

The teaching staff of the Department of criminal law and law enforcement of The D. A. Kunaev Eurasian law Academy, despite working in distance learning, actively conducts research in the field of criminal law, criminal procedure law and criminalistics (within the framework of the registered applied research topic "Problems of applying the norms of criminal and criminal procedure law in modern forensic practice" in JSC "national center for state scientific and technical expertise" in February 2020).                                      

As of today, the work on comparative legal research of criminal law of the Republic of Kazakhstan and the Russian Federation is almost complete (the research is conducted on the initiative of the rector of The D. A. Kunaev Eurasian law Academy, the teaching staff of the Department of Upipd, and the Department of criminal law of the O. Kutafin Moscow Law University). The first Russian-Kazakh textbook on the General part of criminal law has been prepared for publication. In order to improve the effectiveness of distance learning, the Academy has prepared a textbook (consisting of case studies) in the state language (Abdrashev RM, Kuanalieva GA, Rakhimova GN) - a Workshop on criminal law, adapted to the requirements of the new Criminal code of the Republic of Kazakhstan.

In order to digitalize the educational process in the framework of scientific research, not only recommendations of a scientific and practical nature have been developed, but also an Electronic textbook "Juvenile criminal justice" (S. P. Varenikova, T. T. Balashov) has been prepared for publication. Ongoing joint research activities of the faculty Academy (S. P. Varenikova) with the leading scientists of the Republic of Kazakhstan and the Russian Federation (N. Mailis Professor at the University of the Ministry of internal Affairs of the Russian Federation Fedorov and T. – Professor of the Russian Academy of Justice), under which developed a training manual in two parts, "Modern forensic technology."

The study of the best practices of law enforcement agencies of the Republic of Kazakhstan does not remain without attention. Thus, a leading specialist in the field of Prosecutor's supervision, doctor of law, Professor G. K. Utibaev prepared a practical training manual "Collection of statistical data on crime, the results of law enforcement agencies, courts, by branches of Prosecutor's supervision in the Republic of Kazakhstan for 12 months of 2019", which is of great practical importance in the implementation of Prosecutor's supervision in the Republic of Kazakhstan.

A number of students under the guidance of the teaching staff of the Department became winners and prize-winners of Olympiads at the national level.

Since science and innovative technologies are the key components of a modern educational institution, the teaching staff of the Department continues to conduct research within the framework of the fixed theme of research "Problems of applying the norms of criminal and criminal procedure law in modern judicial and investigative practice" in JSC " national center for state scientific and technical expertise»

The Eurasian Law Academy is a well-known research center. Much attention is paid to the scientific activities of the faculty, students and master students. Each year Academy organizes and hosts international and national scientific and theoretical conferences, scientific seminars, symposia and round tables.

Academy publishes two scientific journals, which are included in the list of scientific publications recommended by the Committee for Control of Education and Science of the MES: "Bulletin of the Eurasian Law Academy" and"Kazakhstan Journal of International Law ", issued 4 times a year (quarterly). Magazine "Bulletin of the Eurasian Law Academy"is published since February 1999. "Kazakhstan Journal of International Law" published since February 2000. The cast of the Scientific Editorial Board includes well-known Kazakhstani and foreign scientists: Doctor of Law, professor Rogov I.Y., Ph.D., professor Bulekbaev SB, Doctor of Law, professor A.S. Avtonomov, Doctor of Law, professor Ignatenko G.V., Doctor of Law, professor Kolosov Y.M., Doctor of Law, professor Sarsembayev M.A., professor Koygeldiev M.K., Doctor of History, professor K.T. Zhumagulov, Doctor of Law, professor Maulenov K.S., professor K.K. Aitkhozhin.

The Academy has high scientific potential:  in 2010-2015 academic periods more than 80% of the faculty had scientific degrees. Significant place in the overall structure of the research work is dedicated to carry out scientific research on the programs and projects of fundamental and applied topics which are financed by the Ministry of Education and Science, the Ministry of Justice, the Central Election Commission and other Ministries and departments of the Government of Republic of Kazakhstan.

The Academy maintains close scientific relations and develops scientific cooperation with many foreign institutions of higher education such as the Kyrgyz State Law Academy under the Government of the Kyrgyz Republic, Girne American University, Belarusian State University, Baltic International Academy and others.

Special attention is paid to the scientific life of the Academy students and undergraduates. The structure of the Academy operates scientific student circles. As a result of international and national conferences held among scientists, graduate students and published collections. Students and undergraduates annually take an active part in international and national conferences and competitions, where took prizes and be awarded with diplomas and certificates.

For the purposes of academic mobility and international cooperation Academy invites scholars from near and far abroad countries to give lectures, master classes, seminars and trainings for students and postgraduates. 

In order to engage students in science and promote further development of their potential, annual subject Olympiads, contests for the best research proposal, as well as student scientific conferences are held. The best research proposals are published in conference proceedings and miscellany volumes.

Academy conducts fundamental and applied researches funded by the Ministry of education and science and other ministries and departments.

 

News

For the first time in the 28-year history of education, Eurasian Law Academy named after D. A. Kunayev awarded diplomas of its own sample to graduates of 2021. In 2021, 836 students graduated from the Academy, 731 of them have an academic bachelor's degree, 15-a Master of Law, 90-a Master of Master of Legal Sciences.
